In 2022, Congress passed the Debt Bondage Repair Act (DBRA) as part of the National Defense Authorization Act (NDAA) for Fiscal Year 2022. The Consumer Financial Protection Bureau (CFPB) then issued the Regulation V Human Trafficking Final Rule, effective July 25, 2022, implementing an amendment to the Fair Credit Reporting Act (FCRA) codified at 15 U.S.C. § 1681c-3.
The rule prohibits consumer reporting agencies (CRAs) from furnishing consumer reports containing adverse information that resulted from human trafficking. It empowers survivors to submit documentation to CRAs to block and remove trafficking-related adverse items.
